| Legal license is an effective solution to the copyright problem in the development ofdigital libraries.Without the legal authorization,however,Chinese libraries cannot use legal licenses atpresent.The author thinks that a library is eligible for a subject of the legal license right,and should beauthorized with such a right in China.7 refs. |

| 法定许可使用是图书馆解决数字图书馆建设中著作权问题的有效方法,但因未得到法律授权,我国图书馆目前尚不能行使法定许可使用权。图书馆具有法定许可使用权主体的实质要件,且已得到了理论和实践的证据支持。应尽早立法赋予我国图书馆法定许可使用权。参考文献7。 |
