Abstract:
Marrakesh Treaty adopted in June 2013provides a basis in international law for visually impaired people to have convenient access to works.Authorized entity is the core concept of the treaty, which is defined in this paper as nonprofit organizations endowed with a series of exceptions and limitations related to intellectual property(IP) to solve the problems of scarcity and dissemination of works in accessible formats.Public libraries are appropriate to be authorized entities for their rich experience in serving visually impaired people and necessary resources and capabilities for disseminating works in accessible formats.In order to promote the implementation of the treaty in China, it is suggested that China's IP law should expressly define the authorized entity status of libraries, the exceptions and limitations libraries enjoy, and the range of beneficiaries that libraries provide services for, and so on.6refs.

      2013年6月通过的《马拉喀什条约》为方便视力障碍者获取作品提供了国际法依据。被授权实体是该条约的核心概念,本文将其界定为解决无障碍格式版作品的匮乏与传播问题而被赋予一系列针对著作权的例外与限制的非营利性组织。公共图书馆具有较为丰富的服务视力障碍者的经验,具备传播无障碍格式作品所需的资源和能力,是合适的被授权实体。为了推进该条约在我国的实施,建议我国著作权法明确图书馆的被授权实体地位及其可以享有的例外与限制、所提供服务的受益人范围等。参考文献6。
