early as the Northern Song Dynasty, the archival management system with Chinese characteristics
was established, the archives for the six ministries serving as intermediate archives being one
example. The contemporary construction of the archival management system can be carried out
through inheriting and drawing on the excellent historical tradition of ancient China. The National
Archives Development Plan during the 14th Five Year Plan Period proposed to establish a national
archives strategic backup center. However, due to the institutional dilemma of transferring from
the dual preservation of print and digital copies to the single preservation of digital copies, and the
detailed regulations on “reliable sources, standardized procedures, and compliant elements” in the
practice with archives are still vague, so it is necessary to strengthen the construction of related
management theories.
(2) Improving the power of discourse of China’s archival governance regulations system in the
international community
At the second meeting of the Central Committee for the Comprehensive Rule of Law, General
Secretary XI Jinping made an important decision to strengthen the rule of law on extraterritorial
affairs. The application of current laws and regulations on extraterritorial affairs is not systemic,
with strong defensive nature and lack of initiative [38] . In the creation of rules on archival
governance, China shall first strengthens the research on the theories of foreign archival history
and law, so as to provide reference for improving the power of discourse of China’s archival
governance regulations system in the international community. Additionally, as an important
part in the construction of the legal system of China, the Archives Law, together with the entire
archival governance regulations system, can be given certain extraterritorial effect, and be applied
on extraterritorial affairs, so as to enhance the power of discourse of China’s archival governance
regulations system in the international community.
(3) Constructing the electronic records management theory and electronic archives theory for the
age of evidence
QIAN Yi said in 2009 that “the electronic records management theory provides nutrition
for the future development of archival data”. With the confirmation of the evidence effect of
electronic archives in Article 37 of the new Archives Law, which clearly stipulates that “electronic
archives and archives in traditional carriers have the same effect, and can be used as evidence
in the electronic form”, the legal community in China has gradually noted the evidence effect of
electronic records and electronic archives, and proposed new ideas to supplement the details for
the evidence rule system of electronic records [39] . China shall take this opportunity to map the
innovations of smart judicial practice in the electronic records management theory and electronic
archives theory, as well as the influence, integration and extension of both theories on the theory of
rule of law and judicial practice in China; promote the integrated research on the electronic records
management theory, electronic archives theory and archives appraisal theory; and promote the use
of electronic records and electronic archives as evidences.
